POSSESSION DAY PROBLEMS
A common issue on possession day is the house not being cleaned out and ready to go for the new buyers... it's very annoying and surprisingly hard to combat.

Hey there, Rob Reynar checking in, just doing a possession on a house this morning and the house isn't really cleaned out. There's a lot of personal effects left in this house. For example, there is a bunch of hangers with actually some clothes and there's a backpack over there. Lots of personal effects. Here's a box of stuff with frying a pan in it, there's some shelving and stuff over here. There's a bunch of carpets left here. There's a garbage can and some old vents and just junk. This house has junk left in it. It's the age old debate about what happens on possession. What is the buyer able to do about this situation? There's just stuff left in this house, the seller didn't clean it out properly. Well, there's really not much the buyer can do, the money is on the way. It's the morning of possession, the lawyers are doing their thing. The keys are gonna be releasable on this house yet the new buyer is left cleaning up the seller's mess. Well, a lot of times the REALTOR® like myself will step in and help the buyer. Is it our job? Probably not, but is it customer service? Yeah, it is and hey we've all done it before. But the question is, how does this problem get alleviated in the future? Very difficult question because contractually you should have a whole backread into the contract so that if the buyer comes in on possession and it looks like this they can hold back money to get this cleaned up. But during negotiation the seller or a seller would never agree to that because they feel that it'll just be a cash grab by the buyer. So practically that's the way the contract should be written but it wont work during negotiations and so it can't get accepted that way and this is the result. You're left with the house that's got a bunch of stuff left in it. So I think to me you just got to take the high road a seller. If you drive away from your house, you gotta be comfortable that you did everything you could to make sure that the new buyers are gonna be super happy with the condition. Leaving personal effects in the house, a bunch of junk on the curb that you know the town wont pick up, like is in this case. It's not cool , it's just not cool, you just have to have respect for the people who bought your home.
